GDPR (implemented by DPA2018 in the UK) is bringing in new legal protection for personal information from May 2018. This tells you what personal information I gather via my website, and why, and what your rights are.

The Purpose of processing Client Data 

In order to give professional reflexology treatments, I will need to gather and retain potentially sensitive information about your health. I will only use this information for informing reflexology treatments and associated recommendations concerning aspects of health and wellbeing which I will offer to you. I take basic contact details and information to allow me to contact you and handle bookings.

 

Lawful Basis for holding and using Client Information

 

As a full member of the Association of Reflexologists, I abide by the AoR Code of Practice and Ethics. The lawful basis under which I hold and use your information is my requirement to hold your information for the following legal reasons

  1. ‘claims occurring’ insurance
  2. law regarding children’s records
  3. CNHC requirements to retain information

As I hold special category data (i.e. health related information), the Additional Condition under which I hold and use this information is: for me to fulfil my role as a health care practitioner bound under the AoR Confidentiality as defined in the AoR Code of Practice and Ethics.

 

What information I hold and what I do with it

In order to give professional reflexology treatments, I will need to ask for and keep information about your health. I will only use this for informing reflexology treatments and any advice I give as a result of your treatment. The information to be held is:

I will NOT share your information with anyone else (other than within my own practice, or as required for legal process without explaining why it is necessary, and getting your explicit consent.

It may be helpful for your treatment for me to share your information with another practitioner to whom I may refer you such as chiropractor, chiropodist or even GP to provide any health and medical information.

How Long I Retain Your Information for

I will keep your information for 8 years, unless treating a child in which case, records will be kept until the child is 25 or if 17 when treated then 26.

 

Your data will not be transferred outside the EU without your consent.

Once we receive your complaint, we will follow the five steps below. We are committed to handling all complaints promptly, fairly and confidentially.

1Acknowledgement — within 30 daysWe will acknowledge your complaint in writing within 30 days of receiving it, confirming that we have recorded it and will be investigating.
2Requesting Further InformationIf we need any additional details to fully investigate your complaint, we will contact you as soon as possible and explain what we need and why.
3Investigation & ReviewWe will carry out a thorough and impartial review of your complaint. We will agree a realistic timescale with you once we have all necessary information, and we will keep you updated if there are any delays.
4Decision & OutcomeWe will communicate the outcome of our investigation to you clearly and in writing within one calendar month of receiving all the information needed (this may be extended by up to two further months for complex complaints — we will notify you if this is the case).
5Closure or EscalationIf you are satisfied with the outcome, we will close your complaint. If you remain dissatisfied, you have the right to refer your complaint to the ICO free of charge (see Section 6 below).

If you remain dissatisfied with our response, you have the right to lodge a complaint with the Information Commissioner’s Office (ICO) — the UK’s independent supervisory authority for data protection. This service is free of charge.
